Supreme Court allows Trump Administration to freeze $4 billion in foreign aid

The US Supreme Court on Friday agreed with the Trump Administration in its decision to withhold nearly $4 billion in foreign-aid funding. The court issued an order blocking a lower-court ruling requiring the money to be spent before the fiscal year ends Sept. 30.

The decision came over the dissent of the court’s three Democratic appointees.

Chief Justice John Roberts had previously issued an administrative stay on Sept. 9, temporarily halting US District Judge Amir Ali’s order that the government commit to spending the aid. Friday’s ruling effectively extends that stay while litigation continues. Biden had appointed Ali to the United States District Court for the District of Columbia in 20244, making the first Arab-American and Muslim on the DC court and the fourth Muslim Article III federal judge in US history, 

The Supreme Court justices emphasized their order “should not be read as a final determination on the merits” but reflects “our preliminary view, consistent with the standards for interim relief.”

Justice Elena Kagan, joined by Justices Sonia Sotomayor and Ketanji Brown Jackson, dissented in an eight-page opinion, complaining that the decision “is to prevent the funds from reaching their intended recipients — not just now but (because of their impending expiration) for all time.”

The dispute centers on whether the administration has the legal authority to delay or rescind congressionally approved foreign-aid funds.

With the fiscal year ending Monday and a government shutdown on deck, the funds effectively are frozen permanently.
